Official Sweepstakes Rules and Restrictions
ELIGIBILITY
NO PURCHASE NECESSARY. PURCHASE DOES NOT INCREASE ODDS OF WINNING. THERE IS A LIMIT OF ONE ENTRY PER PERSON. VOID WHERE PROHIBITED.
The Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age. To enter, eligible entrants must complete a Sweepstakes entry form. All requested information on the form must be completed. The entry form will then be placed into the entry pool. The Sweepstakes will be held on October 23, 2024, at the Administrator’s corporate office in Somerset, NJ.
Employees of Administrator (defined below), its affiliated entities, its agencies, its contracted partners, and members of their immediate families are ineligible to participate or win. Void where prohibited. Participation constitutes each entrant’s full and unconditional agreement to these ‘‘Official Rules and Restrictions’’ and the decisions of the Administrator, which are final and binding in all matters related to the Sweepstakes. Winning the Sweepstakes is contingent upon fulfilling all requirements set forth herein. The Sweepstakes consists of one random winner.
TIMING
The selection of a Sweepstakes winner (“Winner”) will be held on October 23, 2024, at approximately 11:00 a.m. at the Administrator’s corporate office in Somerset, New Jersey.
HOW TO ENTER
To participate in the Sweepstakes, submit a completed Sweepstakes entry form to the participating clinic by close of business on October 22, 2024. All information on the entry form must be fully completed in order to be entered into the Sweepstakes.
VERIFICATION OF WINNER
The administrator for the Sweepstakes is Audiology Services Company USA, LLC (d/b/a “HearingLife” referred to herein as the “Administrator”). All potential Winners are subject to verification by the Administrator, whose decisions are final and binding in all matters related to the Sweepstakes. An entrant is not a Winner, unless and until entrant’s entry blank has been verified and entrant has been notified that verification is complete. Administrator will not accept photographs or other evidence of winning in lieu of its validation process. Potential Winners must continue to comply with all terms and conditions of these Official Rules and Restrictions, and winning is contingent upon fulfilling all entry requirements. The Winner will be notified within two (2) days of the Sweepstakes end.
The Winner and any travel companion participating in the Prize (defined below) shall be required to sign a Prize Acceptance Release and Travel Companion Release (as applicable). If Winner and any travel companion do not return the Prize Acceptance and Travel Companion Releases within three (3) days after notification by Administrator that Winner has been selected as the winner of the Sweepstakes, Winner shall be deemed to have forfeited the prize, and Administrator may, but shall not be required to, select an alternate Winner.
PRIZE
The prize consists of two (2) tickets to the BioFreeze USA Pickleball National Championships in Mesa, AZ, transportation to the event (including airfare if reasonably necessary), and a three (3) night stay at a hotel near the event (the “Prize”), to be awarded to one (1) individual Winner. Approximate Retail Value (‘‘ARV’’) of the grand prize package shall not exceed $5,000. Specific prize package will not exceed the value as set forth. Some restrictions may apply. The odds of winning the prize depend on the number of participants in the entry pool.
There is no limit to the number of entrants but there is only one entry permitted for each person who completes a Sweepstakes entry form. Prize may not be transferred to another person for use and is solely for the Sweepstakes entrant. No substitutions permitted except at the sole discretion of the Administrator, in which case a prize of greater or equal value will be awarded. Administrator makes no warranty with respect to the Prize and is not responsible for cancellation or postponement of the Sweepstakes. The cash equivalent of any portion of any Prize is not permitted, except at the Administrator’s sole discretion. Administrator will report value of Prizes as required by law.
All travel arrangements must be made through the Administrator or Administrator’s designee. Certain restrictions and blackout dates may apply. The Winner must travel as and when designated by Administrator or the Prize may be forfeited. The Winner and travel companion must travel together on the same itinerary and possess all required travel documents, including visas and valid passports, if and as applicable. It is the responsibility of the Winner and travel companion to provide proper documentation (including government issued picture identification). All aspects of the travel portions of the Prize must be conducted on such dates as determined by Administrator in its sole and absolute discretion. The dates of departure and return are subject to change at Administrator’s sole and absolute discretion. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. All airline tickets are subject to flight variation, work stoppages, and schedule or route changes. Administrator reserves the right to structure travel route and select hotels in their sole and absolute discretion. The Winner will not receive cash or any other form of compensation if actual travel costs are less than the estimate made in these Official Rules. The roundtrip air transportation element for the Prize begins and ends at the point of departure. The Prize is subject to seat and hotel availability, as well as Administrator’s terms and conditions generally applicable thereto. If in Administrator’s judgment air travel is not required due to winner’s proximity to Prize location, ground transportation will be substituted for roundtrip air travel at Administrator’s sole and absolute discretion. The difference in value will not be awarded to the Winner.
Administrator shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels, venue operators, transportation companies, prize providers or any other persons providing any Prize-related services or accommodations. Administrator is not liable for any missed Prize events, opportunities or expenses incurred as a consequence of flight cancellation/delay or ground transportation delay. No refund or compensation will be made in the event of the cancellation or delay of any transportation or other Prize element except at the sole and absolute discretion of Administrator. Additional Prize details and travel information to be provided to the Winner at the time of Prize notification. Winner and companion are responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Administrator has not and will not obtain or provide travel insurance or any other form of insurance. The Winner may be required to provide a credit card at the time of hotel check-in. Any travel companion of Winner must be at least the age of majority in his or her state of residence as of the date of departure. Travel companion must execute liability/publicity releases prior to issuance of travel documents. Once a travel companion is selected, he/she may not be substituted, except in Administrator’s sole and absolute discretion. Travel is subject to the terms and conditions set forth in this Sweepstakes, and those set forth by Administrator’s transportation carrier(s) of choice. Lost, stolen or damaged airline tickets, travel vouchers or certificates will not be replaced or exchanged. All expenses not specifically mentioned herein, are not included as part of any Prize package, and are solely the Winner’s responsibility, including, but not limited to: hotel taxes, additional ground transportation at the Winner’s destination(s), travel insurance, room service, bag check fees, parking fees, laundry service, food, alcoholic beverages, merchandise, souvenirs, telephone calls, tips, gratuities and service charges. Transportation carrier and hotel regulations and conditions apply. Travel and lodging are subject to availability, and any changes made to either of these will be at the expense of the Winner.
RELEASE
By participating in the Sweepstakes, each participant waives any and all claims of liability against Administrator and its respective employees, directors, shareholders and agents from any and all claims, liabilities and damages arising directly or indirectly out of the award of the Prize or that may be sustained directly or indirectly in connection with this Sweepstakes, for any personal injury or loss which may occur from the conduct of, or participation in, the Sweepstakes, or from the use of any Prize or for any claims, liabilities, losses, repairs, damage or injuries arising out of or in conjunction with the services, merchandise or other benefits obtained by the Winner. In order to receive a Prize, Winner and any travel companion must sign a Prize Acceptance Release and Travel Companion Release provided by Administrator.
PUBLICITY AND MARKETING
By participating, all participants and Winner grant Administrator the non-exclusive permission to use their names, characters, photographs, voices, biographical information, likenesses, contact information, and all other information submitted by participants in or together with a Sweepstakes entry form (“Personal Information”) in connection with promotion of the Sweepstakes and waive any claims to royalty, right, or remuneration for such use. By participating in the Sweepstakes, participants agree that Administrator may disclose Personal Information obtained from participants in the Sweepstakes to third parties and use such information for marketing, advertising, promotional, and other purposes related to Administrator’s and its affiliates’ goods and services offerings. By accepting this prize, Winner agrees to participate in any media interviews that should arise.
GENERAL CONDITIONS
Administrator reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, or other factor beyond the Administrator’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Administrator in its sole discretion. In such an event, Administrator reserves the right to award the prize at random from among eligible entries received up to the time of the impairment. Administrator reserves the right, in its sole discretion, to disqualify any individual, without compensation, it finds to be tampering with the entry process or the operation of the Sweepstakes or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Administrator reserves the right to seek damages from any such person to the fullest extent permitted by law. Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Payment of all federal, state, and local taxes is the sole responsibility of the Winner. Winner will be required to sign an IRS Form W-9 or the equivalent to claim the Prize. The Company reserves the right to award an equivalent substitute Prize should any announced Prizes become damaged or unavailable. The Winner must accept the Prize or equivalent substitute prize(s) as offered. The Winner and Winner’s travel companion will be required to sign a Prize Acceptance Release and Travel Companion Release or other certifying documents prior to being awarded the Prize.
LIMITATIONS OF LIABILITY
Administrator is not liable for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) unauthorized human intervention in any part of the entry process of the Sweepstakes; (3) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (4) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any Prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, the entrant shall forfeit his/her chance for any Prize.
DISPUTES
Except where prohibited, entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a state or federal court located in or geographically nearest to Somerset County, NJ; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorney’s fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant waives all rights to claim, indirect, punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules and Restrictions, or the rights and obligations of the entrant and Administrator in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law rules (whether of the State of New Jersey or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New Jersey.
Printed copies of these Official Rules and Restrictions will be available at the participating clinic or during regular business hours at the Administrator’s corporate office, located at 580 Howard Avenue, Somerset, NJ 08873, or by sending a self-addressed stamped envelope to the company at the address above.
